One of the most common of complaints that are reported after a whiplash injury has been inflicted is neck pain. This tends to take refugee in the upper neck at the base of the skull, the lower neck at the top of the shoulder blades or along the shoulders themselves. Though how such an injury can be associated with so much discomfort is understandable when explained the process of whiplash itself.

Whiplash Compensation:

Whiplash occurs when the driver is hit from the rear of the vehicle, thus propelling them away from their seat and then being pulled back abruptly by their seat belt. The outcome of this situation is the driver’s neck being snapped back, hitting the headrest and causing damage to the muscles and potentially the vertebraes’ in the driver’s spinal cord. Although, the damage caused could be limited by securing the driver’s headrest in the correct position so that it is their head that collides with it and not their neck.

However, there are other injuries that are reported after traffic accidents. Complaints of the deterioration of the upper extremities, back pain, dizziness, visual and auditory disturbances, vertigo, diminished reflexes and cognitive impairments are some of the more frequent claims for compensation.

To justify whether a victim’s claim is genuine or bogus is to carry out medical test on the area injured. Obviously, visible injuries like swelling and bruising will carry substantial weight, as well as x-rays of broken or fractured bones. But due to the majority of symptoms being internal like muscular pain, headaches and dizziness, doctors are unable to dispute their claims. Therefore, insurance companies and courts of law are in a difficult position of having to accept the victim’s claimed injuries as there is no medical evidence to state otherwise.

With the insurance companies and solicitors only having the testimonies of the victim it is perceived that whiplash claims are often bogus and very rarely genuine. With the ambiguity that surrounds the majority of the symptoms whiplash claims can be said to be financially motivated.
